General Terms

This agreement spans our entire relationship with you and governs your use of all InfoTrack Products and the InfoTrack Platforms

Product Terms

These terms apply to your use of specific products and services, and apply in addition to the InfoTrack General Terms. Not all products or services will have special product terms, so check the table of contents for your product.

Third Party Terms

These terms are required by our Third Party Suppliers in respect of your use of Third Party Products, and apply in addition to the InfoTrack General Terms. Examples include terms required by the Land Titles Office and other authorities. Not all products or services will have Third Party Terms, so check the table of contents for your product.

eCompanies

These terms apply to your use of the eCompanies Services.

Financial Disclosure

These terms apply to your use of the Financial Disclosure product, where you are an end user of the Financial Disclosure process initiated by your law firm.

InfoTrack Connect

This agreement contains the terms and conditions that govern a Supplier’s access to and use of the InfoTrack Connect for the distribution of its products.

What are the InfoTrack General Terms?

Your contract with InfoTrack comprises three key elements:

The General Terms span our entire relationship with you and governs your use of all InfoTrack Products and the InfoTrack Platforms.

Please see the InfoTrack Contracts page for the new General Terms and a summary of our contract model.

All Products that you order, access or use through your account on the InfoTrack Search Platform are covered by the General Terms as well as any relevant Product Terms and Third Party Terms.

Your use of the InfoTrack Search Platform and any applications within the platform are also covered by the General Terms.

This update will apply to your use of InfoTrack’s Products and your access to the InfoTrack platform, but rest assured that the changes reflect a greater responsibility on InfoTrack’s part rather than yours.

The changes we have made to our General Terms are predominantly in Your favour to make our General Terms easier for you to navigate and to ensure they are transparent, fair and balanced.  You do not need to make any changes to your processes.

InfoTrack is taking this opportunity to globalise and refresh our General Terms. This will mean one common set of General Terms for all of our global InfoTrack entities, including Australia.

The material changes and differences between the previous General Terms and the new General Terms are summarised below:

  • Globalised terms for our AU, NZ, UK, US and CA contracting entities, including addenda of country-specific terms and amendments.
  • Clarifying the relationship between InfoTrack, You and the Third Party Supplier.
  • Updated Service Variation notice requirements applicable to Us.
  • New terms for InfoTrack’s use of AI in its Products and Services.
  • Updates to warranties and disclaimers in Clause 13.
  • Updates to liabilities and indemnities in Clauses 14 and 15.
  • Updates to InfoTrack’s termination rights in Clause 17.
  • Removal of Your right to audit InfoTrack.
  • New clause for how to provide each other with written notice.

In addition to the General Terms, InfoTrack’s Product Terms and Third Party Terms will also be updated to reflect changes to our InfoTrack products and to pass through updated terms as required by our Third Party Suppliers.

The new General Terms  commence on 26 May 2025 for new Clients and 26 June 2025 for existing Clients. Until then, the current General Terms will remain in effect.

By continuing to use Your InfoTrack account and ordering products from us on or after 26 June 2025, you are agreeing to the updated General Terms.

If you do not agree to our new General Terms, you may simply cease using your InfoTrack account at any time before they become effective on 26 June 2025 without the need to provide us with notice.  Alternatively, you may elect to close your account before the new General Terms become effective.

You will be asked to accept the new General Terms when you first access Your InfoTrack account.

  • General Terms: Your MSA continues unchanged.  The General Terms do not apply to you.
  • Product Terms: These changes may apply to you – please check your MSA.
  • Third Party Terms: These changes may apply to you – please check your MSA.
