How Reliance works in a property transaction

AML/CTF obligations don’t have to create more friction in a property transaction. Reliance allows eligible parties involved in the same transaction to rely on AML/CTF due diligence completed by another reporting entity, where the legislative requirements are met.

For lawyers and conveyancers, that creates an opportunity to make AML/CTF onboarding easier for clients, reduce duplication across the transaction and become a more valuable partner to real estate agents.

What is Reliance?

Reliance is the authorised use of AML/CTF due diligence completed by another reporting entity.

Without Reliance, a person selling or purchasing property may be asked to complete similar identity and verification processes multiple times, with their real estate agent, buyer’s agent, lawyer or conveyancer. Reliance can reduce this duplication.

For example, a lawyer or conveyancer can complete the required customer due diligence as part of their client onboarding process. Where the relevant requirements are satisfied, an eligible real estate agent involved in the transaction may then rely on those checks rather than completing the same process again.

The result is a more connected AML/CTF process across the property transaction.

How does Reliance work?

InfoTrack enables Reliance to operate seamlessly in practice.

1
Client approaches agent to buy or sell property.
2
Agent refers the client to you and sends a Reliance Agreement.
3
Reliance Agreement reviewed and signed by lawyer or conveyancer.
4
Lawyer or conveyancer completes the AML/CTF due diligence on the client and onboards them.
5
AML report is shared back to the agent via a secure workflow.
6
Agent completes an independent risk assessment and onboards the client.
7
Both parties complete the transaction, as usual.

Agreements and reports

AUSTRAC requires a formal Reliance Agreement to be in place between parties who intend to rely on one another’s AML/CTF checks. Beyond satisfying regulatory obligations, these agreements are a chance to formalise and strengthen relationships with referral partners, InfoTrack can support firms in establishing compliant Reliance Agreements while reinforcing trusted, collaborative partnerships.

Workflow

Where your referral partner uses an InfoTrack platform such as Securexchange, your final AML/CTF report can be securely shared directly into their system via a dynamic report, with the appropriate consent controls. Where the counterparty isn’t on an InfoTrack-integrated platform, a comprehensive PDF report can be generated and shared instead.

The benefits of Reliance for legal & conveyancing firms

Real estate agents now have AML/CTF obligations of their own. When onboarding a client, they need a compliant way to complete the required due diligence, either themselves or, where permitted, through Reliance. That gives lawyers and conveyancers an opportunity to provide additional value to their referral partners.

Grow referral relationships

Give real estate agents another reason to work with and refer clients to your firm. A reliable Reliance process can make your firm an easier partner to transact with.

Improve the client experience

Reduce repeated requests for identity information and documentation across the same property transaction, creating a simpler experience for mutual clients.

Reduce administration

Technology-enabled workflows can reduce emails, manual document sharing and back-and-forth between parties

Create consistency at scale

Build Reliance into your existing AML/CTF onboarding workflow rather than managing each referral relationship through an ad hoc process.

Differentiate your firm

Turn a regulatory obligation into a service advantage by providing clients and referral partners with a more connected AML/CTF experience.

Your onboarding questions, answered

Yes. AUSTRAC requires a formal Reliance Agreement to be in place between parties who intend to rely on one another’s AML/CTF checks before Reliance can be used on a matter.

A comprehensive PDF report can be generated and shared instead of a direct system-to-system feed, maintaining flexibility while preserving compliance integrity.

Other eligible parties can rely on a reporting entity’s AML/CTF verification, provided legislative requirements are met. In practice, this is most commonly adopted between lawyers or conveyancers and real estate agents.

No. Agents retain responsibility for compliance requirements even when relying on another Tranche 2 entity’s checks.
