eConveyancing is currently live in Victoria, New South Wales, Queensland and Western Australia for new mortgages, mortgage discharges and refinances.
If a practitioner wishes to complete a transaction through eConveyancing but the lawyer/conveyancer on the other side of the transaction is not a eConveyancing Member, the non-Member will be invited to join and complete the transaction online. If they don’t take this option, the transaction will be completed manually through the traditional paper-based method.
VOI stands for Verification of Identity and is to verify the identity of parties involved with conveyancing transactions. All users of eConveyancing will be required to comply with this.
To complete VOI individuals who are Australian citizens or residents will need to provide original, up-to-date documents in one of the following categories. It must be reasonably satisfied that the prior category cannot be met before using a subsequent category: <br><br> Australian Passport (or foreign passport with an Australian visa grant notice evidencing an Australian resident visa) + Australian drivers licence or Proof of Age Card + change of name or marriage certificate if necessary Australian Passport (or foreign passport and an Australian visa grant notice evidencing as Australian resident visa) + full birth certificate, citizenship certificate or descent certificate + Medicare, Centrelink or Department of Veterans Affairs card + change of name or marriage certificate if necessary Australian Drivers Licence or Proof of Age Card + full Birth Certificate, Citizen Certificate or Descent Certificate + Medicare, Centerlink or Department of Veterans Affairs card + change of name or marriage certificate if necessary

Digital Certificates will be a requirement for eConveyancing users to allow them to sign documents electronically when using eConveyancing. These will be stored on an encrypted USB and will be PIN protected to make them secure.
There will be no need for clients to ‘wet’ sign a land registry document in eConveyancing. A client must sign a Client Authorisation form with their Practitioner, or a mortgage document with a mortgagor, giving permission for the eConveyancing Member to digitally sign documents on their behalf.
If you have multiple people in your organisation signing documents in eConveyancing, each individual will be required to have their own Digital Certificate. As they are used to identify individuals within an organisation they cannot be shared. However, if you have multiple people working on documents but only one person signing them, then you will only need one Digital Certificate. The Digital Certificate will be issued in the name of the person nominated to be the Subscriber Manager. The Subscriber Manager can then request additional certificates for other staff in their organisation as required.
